The Supreme Court dismissed petitions related to conducting elections through ballot paper and ensuring 100% cross-verification of Electronic Voting Machines (EVMs) and VVPAT slips.
However, a significant decision was also made. For the first time in the 42-year history of EVM usage, the court opened the path for an investigation.
On April 27, 2024, the bench of Justice Deepankar Datta and Justice Sanjeev Khanna unanimously pronounced the decision.

1. Common Man, i.e., Voter
– With this decision of the Supreme Court, there will be no change in the process of common people casting their votes. They will go to the polling booth. Ink will be applied to their finger. The election officer will press the button of the control unit. The voter will press the button in front of the candidate’s name on the voting ballot unit and then for a few seconds, they can see their slip in the VVPAT light.

2. Political Parties and Candidates
– If any candidate coming in second or third place has doubts, they can complain within 7 days of the result being announced.
– After the complaint, engineers from the company that manufactures the EVMs will investigate.
– Inspection of 5% of the total EVMs in any parliamentary constituency can be done. – The candidate or their representative who raises the complaint will choose these 5% of EVMs.
– The candidate will have to bear the cost of this inspection, as stated by the Election Commission.
– Information regarding the time limit and cost of the inspection will be shared soon.
– If it is proven after the inspection that tampering has been done with the EVMs, the candidate who lodged the complaint will be reimbursed the full cost of the inspection.

3. The Supreme Court has given three directives to the Election Commission:
– After the completion of the symbol loading process, seal this unit. The sealed unit should be stored in a strong room for 45 days.
– Test the suggestion for counting paper slips from the electronic machine.
– Also, explore whether, apart from the election symbol, barcodes can also be used for each party.
