– On February 20, 2024, the Supreme Court delivered its verdict in the Chandigarh Mayor election case, invoking Article 142 of the Constitution.
– The court declared Kuldeep Kumar, a candidate of AAP-Congress, as the Mayor of Chandigarh.
– It also ordered to file a case of “malpractice” against the election officer Anil Masih.
What was the issue?
– During the Chandigarh Mayor election in February 2024, the election officer (a BJP leader) Anil Masih had declared it invalid by marking a sign on the ballot papers of 8 councilors.
– Whereas there was a majority of AAP and Congress in the council.
– This misconduct was recorded on CCTV cameras.
– The matter reached the media, after which the joint candidates of AAP and Congress filed a petition in the Supreme Court.
– Then the Supreme Court intervened in this matter and delivered a verdict.
Article 142:
– Article 142 comes under Part 5 (The Union) Chapter 4 (The Union Judiciary) of the Indian Constitution.
– This article gives the Supreme Court the special power to provide ‘complete justice’.
– Under this, if other laws do not apply in a case, then the court’s decision will be considered paramount.
– This article is divided into two parts.
– Article 142 (1) and Article 142 (2)
– Article 142 (1) gives the Supreme Court the authority to issue separate orders by removing from the existing law if complete justice cannot be done by the existing law in a case.
– This order will remain in force until the government oparliament does not provide any specific provision regarding the matter.
– Article 142 (2) gives the Supreme Court the right to summon a person, demand documents, and investigate the case of the guilty.
– It also gives the right to punish the guilty.
