– Opposition parties associated with the INDIA alliance submitted a notice of motion to the Lok Sabha Secretary-General on 10 February 2026 to remove Lok Sabha Speaker Om Birla from his post.
– The notice alleges that Om Birla conducted the proceedings of the House in a “clearly partisan” manner and “misused his office.”
– Subsequently, media reports stated that Om Birla, citing “moral grounds,” would not preside over the proceedings of the House until the motion seeking his removal is taken up for hearing.
Four grounds mentioned in the notice for removing the Speaker:
– Not allowing Leader of the Opposition Rahul Gandhi to deliver his full speech during the Motion of Thanks to the President’s Address on 2 February. The motion states, “This is not an isolated incident. The Leader of the Opposition in the Lok Sabha is almost always not allowed to speak.”
– Arbitrarily suspending eight opposition MPs for the entire Budget Session.
– Allowing BJP MP Nishikant Dubey to make objectionable personal remarks against former Prime Ministers and not restraining him. It is alleged that he was not reprimanded even once for disregarding established traditions and norms of decorum.
– Misusing the constitutional office by expressing a “false” apprehension that Congress members were moving toward the Prime Minister’s seat. His remarks from the Chair were described as a “misuse of this constitutional office.”
About Om Birla:
– He first became Speaker in the 17th Lok Sabha and is now the Speaker of the 18th Lok Sabha.
– He is an MP from the Kota Lok Sabha constituency in Rajasthan.
Why did the Opposition give the notice despite lacking majority in the House?
– The Opposition does not have the majority required to remove Speaker Om Birla, but it wants to send a message through this move.
– During Lok Sabha proceedings, when opposition MPs accuse the Speaker of arbitrary functioning, such remarks are not recorded.
– However, discussion on a removal motion will be recorded in parliamentary history.
Article 94:
– Provides for the resignation and removal of the Speaker and Deputy Speaker of the Lok Sabha.
– The Speaker can resign by submitting resignation to the Deputy Speaker, and the Deputy Speaker can resign by submitting it to the Speaker.
– They can be removed by passing a resolution in the Lok Sabha, provided that at least 14 days’ prior notice is given and it is passed by a simple majority.
Rules of Procedure of the Lok Sabha:
– Govern the process and notice requirements.
Who can move the motion?
– Any Member of Parliament (MP) of the Lok Sabha can move the motion, but it must have written support from at least 50 MPs.
– The notice is considered valid only if 50 MPs sign it.
– A minimum of 14 days’ notice is mandatory before moving the motion.
How is the motion decided?
– The motion is discussed in the Lok Sabha and then put to vote.
– If a simple majority (more than 50% of members present and voting) supports it, the Speaker is removed from office.
Role of the Speaker during the motion:
– On the day the motion is discussed, the Speaker does not preside over the House. Instead, the Deputy Speaker or another member presides.
– The Speaker can participate in voting but does not exercise a casting vote.
– A casting vote is the deciding vote given by the Speaker in case of a tie. However, in a motion of no-confidence/removal brought against himself, the Speaker does not exercise a casting vote.
Has this happened before?
– So far, no Lok Sabha Speaker has been removed through a no-confidence motion.
– However, notices and political controversies have occurred several times.
